Terms of Service - Hobbyster Creator Studio

1. Acceptance of Terms

Welcome to Hobbyster Creator Studio ("Service", "Platform", "we", "us", "our"), operated at https://hobbysters.cc. By accessing, browsing, or using our Service, you ("you", "user") agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not access or use the Service.

2. Description of Service

Hobbyster Creator Studio is a software-as-a-service (SaaS) platform that helps small businesses, content creators, and solo entrepreneurs automate the generation and publishing of short-form video content to TikTok. The Service includes:

Automated extraction of product information from publicly accessible websites
Generation of short-form video content (vertical 1080x1920, up to 60 seconds) using product imagery
Publishing of generated videos to a user's authorized TikTok account through TikTok's official Content Posting API
Management of multiple TikTok accounts per user
Scheduling and queue management for video publication

3. Eligibility & User Accounts

You must be at least 18 years old to create an account. By registering, you represent and warrant that you meet this age requirement. You are responsible for:

Providing accurate registration information (name, valid email address)
Maintaining the confidentiality of your password
All activities that occur under your account
Notifying us immediately of any unauthorized access

You may not transfer, sell, or share your account credentials. We reserve the right to terminate accounts that violate these Terms.

4. TikTok Integration

To publish videos to TikTok, you must voluntarily connect your TikTok account through the official OAuth 2.0 authorization flow provided by TikTok. By connecting your TikTok account, you authorize Hobbyster Creator Studio to:

user.info.basic: Read your TikTok profile information (open_id, nickname, avatar) for the purpose of displaying which account is linked
video.upload: Upload video files to TikTok's content posting infrastructure on your behalf
video.publish: Finalize publishing of uploaded videos so they appear on your TikTok profile

You may revoke this authorization at any time by either:

Clicking the "Disconnect" button on your TikTok Accounts page in our application, or
Revoking access through your TikTok account settings at https://www.tiktok.com/setting

Upon disconnection, we immediately delete all stored OAuth tokens from our systems.

5. User Content & Responsibility

You retain full ownership of content you create, upload, or generate through the Service ("Your Content"). You are solely responsible for:

Ensuring compliance with the TikTok Community Guidelines for all content posted via our Service
Holding all necessary rights, licenses, and permissions for source materials (product images, descriptions, brand logos)
Compliance with copyright, trademark, and intellectual property laws
Accuracy of product information, prices, and claims made in generated videos
Compliance with applicable advertising and consumer protection laws

6. Acceptable Use

You agree NOT to use the Service to:

Post content that is illegal, fraudulent, misleading, defamatory, or violates third-party rights
Scrape websites in violation of their Terms of Service or robots.txt directives
Send spam, unsolicited bulk content, or engage in coordinated inauthentic behavior on TikTok
Attempt to reverse-engineer, decompile, or extract source code from the Service
Interfere with the Service's operation (DDoS, brute force, exploit attempts)
Use the Service for any purpose that violates TikTok's Terms of Service or community guidelines
Attempt to bypass quota limits, rate limits, or other technical restrictions

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service is provided "as is" and may undergo maintenance, updates, or temporary outages. We are not liable for any downtime, including outages caused by third-party services (e.g., TikTok API, hosting providers).

8. Intellectual Property

All intellectual property rights in the Service (including software, branding, documentation, and design) are owned by Hobbyster Creator Studio or our licensors. These Terms do not grant you any rights to our trademarks, logos, or branding except as necessary to use the Service.

9. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your account if you:

Violate these Terms or applicable laws
Engage in fraudulent or abusive behavior
Fail to pay subscription fees (if applicable)

Upon termination, your data will be handled according to our Privacy Policy, including secure deletion of TikTok credentials and generated content.

10. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, secure, or always available. We are not affiliated with, endorsed by, or sponsored by TikTok Inc. or ByteDance Ltd.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Hobbyster Creator Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from your use of or inability to use the Service.

12. Indemnification

You agree to indemnify and hold harmless Hobbyster Creator Studio, its operators, and affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms or applicable laws.

13. Changes to Terms

We may modify these Terms from time to time. Material changes will be communicated via email or through a notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of Romania (European Union). Any disputes shall be resolved in the courts of Bucharest, Romania, unless required otherwise by applicable consumer protection laws.
